This article focuses on analyzing and identifying the characteristics of losses arising from the marketing and supply of digital tourist accommodation services based on the business competition law system in Indonesia and on the formulation of marketing and supply arrangements for digital tourist accommodation services that are healthy and fair for all tourism accommodation service business actors. normative research methods used in this research, with primary legal materials in the form of laws and regulations related to monopolistic practices and unfair (...) competition. Malang City has evolved into a prominent hub for students. Embracing this new role, it has become a sought-after destination for learners from outside Java who wish to pursue their education at local universities. The influx of international students brings a vibrant intercultural dynamic to the city, affecting both the local community and the students themselves. As these students undergo the adaptation process to integrate and thrive in their new environment, they often face challenges such as culture shock, which arises (...) from insufficient preparation and knowledge about their new surroundings. Culture shock can be minimized in the process of student adaptation by the application of intercultural communication, which can bridge the constraints of understanding in society. This research aims to examine the impact of intercultural communication on the adaptation process of Hindu students in Malang City, focusing on how it can reduce the incidence of culture shock. Employing a qualitative-interpretative approach, the research gathers data through comprehensive and interactive interviews based on the informants' personal experiences. Informants are selected using purposive sampling, and data is analyzed using the Miles and Huberman framework, which involves data collection, reduction, and interpretation. The outcomes highlight that culture shock among Hindu students in Malang City is influenced by internal factors, including personal abilities, insufficient factual information, and experiences in intercultural social interactions. While external factors include language, food, customs, and climate. The phases of culture shock development in the adaptation process include the optimistic phase, cultural phase, recovery phase, and adjustment phase. The duration for students to transition from experiencing culture shock to achieving adaptation ranges from one month to a year. Effective intercultural communication plays a crucial role in this adaptation process, helping to reduce the impact of culture shock by facilitating stages of convergence, divergence, and maintenance. Tri Hita Karana is a traditional Balinese philosophy that emphasizes the importance of balance in the relationships between humans and God, humans and others, and humans and the natural environment. Although this principle underpins many aspects of life, its application in architectural and urban planning often faces various challenges. This research identifies the gap between traditional principles and the demands of modern development. A qualitative case study approach was used in Kedonganan Traditional Village, Kuta, Bali, employing in-depth interviews and direct (...) observation methods. The results of the study show that the people of Kedonganan Traditional Village still uphold customs and cultural traditions, which are implemented in various aspects of daily life, including religious activities, mutual cooperation, and environmental management. Collaboration between the government and traditional communities has proven effective in maintaining ecological, social, and spiritual balance. Additionally, the findings indicate that cultural, architectural and landscape elements remain relevant and functional in community life. The implications of this research highlight the importance of integrating Tri Hita Karana values into development policies to achieve sustainable balance. (shrink)

Abstrak: Tulisan ini bertujuan mempresentasikan etika diskursus Jürgen Habermas dan kemudian menarik kemungkinan relevansinya bagi dialog interreligius. Berbeda dengan global ethics Hans Küng yang menjadikan “problem of the good” sebagai pokok pembicaraan, etika diskursus hanya membicarakan bagi kehidupan bersama dalam masyarakat majemuk. Karena itu, etika diskursus tidak ber-tendensi mengejar substansi nilai-nilai etis dari berbagai pandangan dunia (world-view) dalam kelompok-kelompok kultural maupun religius yang berbeda-beda itu. Sebaliknya, etika diskurus hanya menawarkan sebuah prosedur untuk memecahkan masalah hidup bersama secara adil di tengah (...) kemajemukan pandangan nilai dan keyakinan yang tak terbantahkan. Etika ini tidak bertujuan melenyapkan perbedaan-perbedaan identitas para warga dengan segala kekayaan kultural dan religiusnya, melainkan berupaya menjamin kelangsungan hidup bersama secara bermartabat tanpa kehilangan identitas individual. Tulisan ini dibagi dalam dua bagian. Pertama, penulis akan mendeskripsikan hakikat etika diskursus. Kedua, penulis akan menarik kemungkinan aplikasi etika diskursus bagi dialog interreligius. Abstract: This paper aims to present the Discourse Ethics of Jürgen Habermas and find its relevance for interreligious dialogue. In contrast to the global ethics of Hans Küng that concerns the “problem of the good,” discourse ethics deals only with “the problem of justice” within a pluralistic society. Therefore, discourse ethics does not attempt to find the commonality of the ethical different values of the various group either culturally or religiously. Rather, discourse ethics offers a procedure for solving inter-religion and inter-cultural problems within a community or society fairly and reasonably. In other words, discourse ethics does not aim to eliminate the distinctive attributes of every citizen within their own cultural and religious belief, but rather ensures that each person or each group live together with dignity without losing their identity. This paper is divided into two parts. First, the author will describe what discourse ethics is. Second, the authors will discuss the possible application of discourse ethics for interreligious dialogue. This paper will end with a short conclusion. This article aims to explore critically John Rawls’ concept of political liberalism which is meant to be a response to the conflict and contestation of ideologies, religions, and other comprehensive doctrines in contemporary plural society. The key question is how the universalized principles of justice can be formulated in the conditionof radical pluralism characterized by contestation of different comprehensive doctrines. In answering this question, John Rawls suggests the concept of overlapping consensus and public reason. While taking accountof the fundamental contribution (...) of John Rawls’ thought in the process of overcoming conflicts in a plural society, this essay discusses further some weaknesses of Rawls’ concept of political liberalism, and at thesame time proposes a new model of political philosophy which provides room for fundamental dissent. This new political philosophy can be called liberal fundamentalism. Fundamentalism basically expressesitself in public sphere in the form of liberality. This essay argues that liberal fundamentalism can create a social condition where fundamental moral differences are accepted, respected, and recognized. Abstrak Tulisan ini bertujuan membahas secara kritis konsep liberalisme politik John Rawls sebagai jawaban atas konfl ik dan kontestasi pandangan hidup atau doktrin komprehensif yang menandai masyarakat kontemporer yang plural. Pertanyaan pokok yang dibahas dalam tulisan ini ialah, bagaimana prinsip-prinsip keadilan yang berlakuumum dapat dirumuskan dalam kondisi factum pluralisme atau pertarungan doktrin-doktrin komprehensif tersebut. Untuk menjawab pertanyaan ini, Rawls menganjurkan dua konsep yakni overlapping consensus dan public reason. Tanpa mengabaikan kontribusi Rawls dalam menyelesaikan konflik dalam masyarakat plural, tulisan ini lebih jauh menunjukkan kelemahan konsep liberalisme politik John Rawls, dan menganjurkan sebuah filsafat politik baru yang harus memberi ruang bagi disensus-disensus fundamental. Filsafat politik baru itu dapat dinamakan posisi fundamentalisme liberal. Sebuah fundamentalisme yang mengungkapkan diri di ruang publik dalam bentuk liberalitas. Artinya, kondisi sebuah masyarakat yang memberi ruang bagi pertentangan-pertentangan etis fundamental, namun dihadapi dengan sikap pengakuan dan penghargaan atas perbedaan fundamental tersebut. Since the issue of the war against global terrorism emerged, the discourse surrounding the concept of human dignity returns as a normative basis for the protection of basic human rights. The term human dignity has existed since the days of ancient Greek philosophy and was further developed in dialogue with medieval Christian theology and the secular thought of modern times. This article places special emphasis on the understanding of human dignity as defined by a secular thinker and exponent of the (...) Enlightenment, Immanuel Kant. The concept of human dignity as developed by Immanuel Kant is rational and transcends the boundaries of religions, cultures and ideologies; therefore it is suitable as a normative basis for a multicultural society. But the article also does not turn a blind eye to some critical observations offered by adherents of particular ethics concerning the Kantian universal ethics. These critical observations emphasize the ethical principle of substantial solidarity in order to overcome the dangers of anonymity in each model of formal ethics. Abstrak: Sejak isu perang melawan terorisme global muncul, wacana seputar konsep martabat manusia kembali menjadi aktual sebagai basis normatif dalam melindungi hak-hak dasar manusia. Istilah martabat manusia sudah lahir sejak zaman Yunani kuno dan dalam perjalanan sejarah berdialog dengan pandangan teologi Kristen Abad Pertengahan serta pemikiran sekular abad modern. Tulisan ini mencoba memberikan penekanan khusus pada pemahaman tentang martabat manusia seperti dirumuskan oleh pemikir sekular abad pencerahan yakni Immanuel Kant. Konsep martabat manusia yang dikembangkan oleh Immanuel Kant bersifat rasional dan melampaui sekat-sekat agama, ideologi dan budaya; sehingga dipandang layak untuk dijadikan basis normatif sebuah masyarakat multikultural. Akan tetapi, penulis juga tidak menutup mata terhadap beberapa catatan kritis yang diberikan oleh beberapa pengikut etika khusus berkaitan dengan etika universal Kant. Catatan-catatan kritis tersebut menekankan aspek solidaritas substansial dalam etika untuk mengatasi bahaya-bahaya anonimitas dalam setiap model etika formal. Liberalisme dianggap mengenal individu hanya sebagai subjek hukum dan karena itu hanya dapat memperhatikan tuntutan validitas hukum. Dalam kaca mata liberalisme, kesetaraan subjek-subjek hukum hanya dapat dijamin jika aspek-aspek tradisi, kultural dan konsep hidup baik dijauhkan dari politik. Namun apa yang menjadi objek pengakuan justru aspek-aspek ini. Tulisan ini memperkenalkan konsep konsep pengakuan intersubjektif Axel Honneth. Konsep (...) pengakuan intersubjektif melampaui paham pengakuan interkultural seperti diperkenalkan oleh tokoh seperti Charles Taylor. Dalam paradigma intersubjektif, pengakuan tidak hanya dilihat pada tataran relasi interkultural, tapi dipahami sebagai sebuah antropologi. Pengakuan mengkonstruksi manusia sebagai subjek. Hal ini ditunjukkan Honneth dalam uraiannya tentang pelbagai tingkatan interaksi antarmanusia yakni tataran cinta, hukum dan solidaritas. Abstract: The separation between private and public spheres is the solution of liberalism to the challenges of plurality in modern societies. In the perspective of politics of recognition this solution of liberalism is insufficient. Liberalism is considered to recognize the individual only as a subject of law and therefore can only attend to the demands of legal validity. In the perspective of liberalism, equality of legal subjects can only be guaranteed if the aspects of tradition, culture and the concept of a good life are seperated from politics. But precisely these aspects are the object of recognition. This paper introduces the concept of intersubjective recognition of Axel Honneth. The concept of intersubjective recognition goes beyond intercultural recognition as introduced by Charles Taylor, for example. In the intersubjective paradigm, recognition is not only seen at the level of intercultural relations, but understood as an anthropology. Recognition constructs the human being as subject. This is shown by Honneth in his account of the various levels of human interaction, that is the level of love, law and solidarity. In the end of the section 219a 10-21 of the 11th chapter of Physics IV Aristotle defines the ‘before and after’ in movement as follows: «The ‘before and after’ in motion is identical ὅ ποτε ὂυ with motion, yet differs from it τò εἶυατ αύτῷ, and is not identical with motion t (11. 19-21)». These lines convey the answer to the question whether the ‘before’ and after’ are the same thing as movement or not: in one sense, ὅ ποτε ὂυ, (...) they are, in another sense, τò εἶυαι, they are not. But, first and foremost, the opposition of ὅ ποτε ὂυ to то τò εἶυαι is very useful to Aristotle to solve the main aporia of the chapter about the contradictory – at a first sight – and concurrent diversity and identity of the instant, τò υῠυ. Therefore, this aporia will be solved, if only ὅ ποτε ὂυ and то τò εἶυαι mean two really opposing points of view. But what are these points of view? What do they really mean? As it is well known, the phrase ὅ ποτε ὂυ is one of the most enigmatic in the Aristotelian corpus, and yet one of the most important in his physical research because concerns the nature and definition of time. The lower was the agreement among the scholars, with greater force the debate has flared up. An alternative way for attempting to successfully tackle the problem is take in consideration the occurrence of the same phrase in other works than Physica, since the other occurrences of it in the 11th and 14th chapter of the same book are of no help. It is present in only two other works: On Generation and Corruption, I, 3, 319b 3 and Parts of Animals, II, 2, 649a 15; II, 3, 649b 24. In both works we are led to take ὅ ποτε ὂυ as being associated to such terms as ύποκεἰμενον and ύπóκειται. So, Aristotle seems to point out a contrast between a formal respect and a material respect by the opposition of τò εἶυαι to ὅ ποτε ὂυ. The reading of all passages from Physics – particularly, 219a 20-21 – wherein ὅ ποτε ὂυ occurs provides further confirmation of this contrast. As matter of fact, in all three works τò εἶυαι was employed by Aristotle for the same purpose: to set out the difference between a substratum of its own and its ability to actually exist just as substratum underlying worldly things. This difference implies that a substratum cannot but be limited by or relating to time. A condition which is emphasized by the presence of the term ποτε. In conclusion, each instant comes out from the division by the ‘before and after’ of movement’s substratum. If this substratum is found to exist in time, the ‘before and after’ turns out to be ‘what that is now and then’ (ὅ ποτε ὂυ), which, reversely, is the same as the ‘before and after’ in the movement. The occurrences of the incomplete phrase (as ὅ ποτε plus other verbal voices than ὂυ) in other works substantiate this view. (shrink)

Requires signed TDF. ;Two elements in Kripke's notion of "rigid designation" are distinguished: "genuine reference", which has to do with the semantic function of a singular term, and "rigid designation", which has to do with the behaviour of a singular term in modal contexts. Accordingly, the discussion is divided into two parts. ;In Part I, arguments from functionalism against "genuine reference" are considered and rejected, but it is claimed that certain Cartesian (...) arguments constitute a formidable objection against this notion. Therefore, while descriptivism must be rejected "genuine reference" is too strong as an alternative. "Weak reference" is suggested as the required notion, and some of its characteristics are delineated. ;In Part II, the problems concerning the contingent a priori and the necessary a posteriori arising from the second element in Kripke's notion are discussed, depending on whether the names involved are ordinary proper names, or "descriptive" names. Evans' arguments concerning descriptive names are considered, and it is argued that, because of a new distinction between deep vs. superficial rigidity, Davies and Humberstone fail in formulating them more exactly; but the informal arguments, though inconclusive, are intuitive. As for ordinary proper names, and on the basis of conclusions reached in Part I, the case for contingent a priori truths involving such names is undermined. In the case of necessary a posteriori truths involving ordinary proper names, the strategies of denying the necessity or the a posteriority of the examples are discussed, and found wanting. However, since there are reasons from other areas for denying the coincidence of the necessary and the a priori, Kripke's examples do not call for a radical departure from currently held views. Central to much medical ethical analysis is the concept of the role of the physician. While this concept plays an important role in medical ethics, its function is largely tacit. The present paper attempts to bring the concept of a social role to prominence by focusing on an historically recent and rather richly contextured role, namely, that of consultation liaison psychiatry. Since my intention is primarily theoretical, I largely ignore the empirical studies which purport to develop the detailed functioning of (...) the role. My limited intent is to draw attention to the theoretical complexity of the consultation liaison role as an example of the general relevance of role concepts to medical ethics. For this reason, consultation liaison psychiatry will function as an illustration of fundamental concepts of medical ethics rather than as a subject of analysis in its own right. Similarly, the concept of the social role will be developed only as is necessary to explore the general relationship between the consultation liaison role and ethical analysis. If this approach is on the right track, it has three main implications for the ethics of informed consent. First, because of the expectation-fulfillment mechanism, the process of informing cannot be considered independently from the potential effects of treatment. Obtaining informed (...) consent influences the effects of treatment. This provides support for the authorized concealment and authorized deception paradigms, and perhaps even for outright deceptive placebo use. Second, doctors may easily fail to consider the potential benefits of conditioning, leading them to misjudge the trade-off between beneficence and autonomy. Third, how attentional-somatic feedback loops play out depends not only on the content of the informing process but also on its framing. I will argue that some changes of mind about what it is best to do are akratic occurrences and that the associated overt actions are derivatively akratic, and I will explain how akratic episodes of this kind are possible. Even if Socrates is mistaken in denying the reality of strict akratic action, he has identified an important phenomenon that deserves more attention than it has received.

I examine the contribution that the first part of Maurice Blancot's recit Death Sentence makes to his understanding of the relationship between philosophy and literature. I use a reading of the Kantian, transcendental account of literature in “How is Literature Possible” as the starting point for an analysis of the way in which Blanchot uses secrets in describing J.'s death in Death Sentence, linking secrecy up with the imaginary, ambiguity and dissimulation. The purpose for this refinement is to challenge the (...) philosophical tradition's self-understanding, particularly as exhibited in Hegel. This challenge is seen by reading the account of grief in the first part of Death Sentence as a parody of Hegel's interpretation of Antigone. (shrink)

This paper offers a revised political conception of human rights informed by legal pluralism and epistemic considerations. In the first part, I present the political conception of human rights. I then argue for four desiderata that such a conception should meet to be functionally applicable. In the rest of the first section and in the second section, I explain how abstract human rights norms and the practice of specification prevent the political conception from meeting these four desiderata. In the last (...) part of the paper, I argue that full-fledged tolerance in the international order – that is tolerance-as-non-intervention and tolerance-as-respect – should be attached to (1) compliance with jus cogens norms and to; (2a) a political community recognizably organized as a community of inquiry that is; (2b) committed to the specification and incorporation or expression of the idea of human rights within its local legal system. Philosophers have recently argued that since there are people who are blind, but don't know it, and people who echolocate, but don't know it, conscious introspection is highly unreliable. I contend that a second look at Anton's syndrome, human echolocation, and ‘facial vision’ suggests otherwise. These examples do not support skepticism about the reliability of introspection.

It is possible for persons to deserve evaluative attitudes such as admiration and disdain. There is an apparent asymmetry between positive and negative attitudes, however. While the latter appear to be subject to what I will call a "control requirement," the former do not appear to be so subject. I attempt to explain away this asymmetry by appeal to pragmatic factors.

Born into a poor, Muslim family at the end of the 19th century, Gama became World Champion wrestler by defeating the reigning Polish champion in London in 1910. By focusing on the life of Gama, the heroic representations of Gama that appear in the Hindi language literature, and the transformations in wrestling regimens that have occurred over the past several centuries, I locate the discourse and practice of wrestling within a context of intersecting concerns with nationalism, class identity and embodied (...) consciousness. To articulate the way in which subaltern identity is embodied in relation to nationalist ideas about masculine fitness, and in relation to the state as a political institution, I provide an analytic interpretation of the heroic body that focuses on themes of nervousness and obsession. An Internet survey revealed that day-of-the-week (DOW) stereotypes (i.e., “Monday blues”, “Wednesday hump day”, “TGIF”, etc.) were pronounced when subjects predicted their moods for each day of the upcoming week, less obvious when they remembered their moods from each day of the preceding week, and least apparent in the momentary moods they actually experienced on each day. In a second study involving 2-hour, in-home interviews, subjects reporting looking forward to weekends because of the lack of structure and discipline and the (...) freedom to choose activities, yet much of their weekend time was spent fulfilling a need to be productive, which often involved activities that, in many ways, simulated paid work. The content of these interviews suggested that people tend to overvalue future discretionary time on the weekend, assuming that two days of uninterrupted idle time will be more enjoyable than it actually is. In a more general sense, these results suggest that the predicted and remembered moods in the initial survey were driven by DOW stereotypes, which facilitated rapid judgements given the simple scaled response format. However, the depth interviews revealed that moods experienced throughout the week are more nuanced in terms of how they are remembered, described, and linked to recently passed, current, and immediately anticipated events, perhaps explaining why DOW stereotypes were less obvious in the reported momentary moods. Excellent compilation of incidents of irrationality in India with special reference to Tamil Nadu.

Lucian of Samosata is often painted as a satirist and rhetorician, but also as an anti- philosopher. In my contribution I show that he is, instead, involved in a sophisticated metaphilosophical project which follows a Socratic spirit. Yet, there are (almost) no positive characterisations of philosophy to be found in his works: schools, doctrines, and individuals all become the object of biting criticisms or ridicule. Given this situation, we ought to seek the Socratic aspects of Lucian’s project in his critical (...) performance as well as in the criteria his attacks are based on, namely consistency, evidence, and fidelity to the given argument. His metaphilosophy unfolds around three distinctions. The first distinction being that between philosophy and philosophers. In the first part of the paper, I elaborate how Lucian attacks faux philosophers for failing to practice what they preach, that is, for their lack of performative consistency. I also discuss possible positive portrayals of philosophers in his works. The second distinction, which occupies us in the second part, is that between philosophy and philosophies, the multiple schools and traditions. From this multiplicity he constructs a starting problem for philosophy: how do we know which of the philosophies to choose in the first place without already presupposing a philosophical position? A third difference can be adduced, namely that between doctrinal and non-doctrincal philosophy. In Lucian’s perspective, which I summarize in the concluding part of the paper, philosophy is a way of reflexive critical thinking, rather than the dogmatic adherence to the doctrines of a given school. The infallible condition of ethicalarete may be found to be formulated in the last words of the Chronicle concerning humanity which consists in tolerant indulgence of others’ vices and modesty about one’s virtues.
